Attitude

One Malaysia, One Love

“When it comes to one of the most fascinating chapter of Malaysia’s history (1946-1969), memories of rapture and joy, misery and shame would crop up instantly in my mind and without doubt.”

This is a confession made by Madam Chan Ying, 86 years old who survived the Japanese occupation and witnessed the glory of nation Independence Day herself. She admitted that the Japanese occupation had been a hard and thorny time for most Malaysians back then. Hence, being part of the nation’s Independence Day was like seeing a mission impossible being made possible right in front of her eyes. Five centuries after the Portuguese first stepped their foot on Malacca, marking the start of European colonization, Malaya finally gained its sovereignty in 1957.

The post-war propelled in an eruption of royal carousing and it is definitely a joy shared by millions of Malaysians jointly. In the chronological records of Malaysia, there is one man who is said to exemplify this celebrated era the best and he is none other than Tunku Abdul Rahman Putra Al-Haj. This legendary Cambridge educated lawyer championed Independence through endless of hardships and struggles. He was acknowledged as the Malaysia’s first ever prime minister. On 31 August 1957, Tunku, the father of Malaysia with his arm held up high, gave the prominent shout of “Merdeka” (independence) and the much awaited throng of emotional citizens thundered the newly built Merdeka Stadium with delight. This was the day when the British Union Jack was lowered and Malayan flag was raised with poise. This is the moment where every single Malaysians shared the same happiness, all at once. The remarkable moment on 31 August 1957 is immortalized in the mind of many Malaysians, at least the older generations who can truly understand the meaning of “merdeka”.

At the epoch of Independence, Malaysia was already very much a plural society. In fact, after the formation of Malaysia, citizens grew  progressively more aware of their identity as Malaysians. With the emergence of a new generation born and bred in Malaysia, ties to their very own native land were slackened off. Rapid growth of the nation tailed Independence, where high-rise buildings began to change the skyline and new planned townships such as Petaling Jaya revolted the way Malaysians used to live. The streets were also becoming ever more hectic with traffic. A whole new generation of Malaysians has emerged.

Merdeka is one simple word yet with infinite definition depending on each individual. As a post-independence child, Madam Chong Poh Yen, 46 years old pointed out “merdeka” is all about freedom and sovereignty. It is also about a war-free nation and peaceful country. Most people tend to take things for granted and the value of “merdeka” is often neglected especially by the younger generations. This is due to the fact that they are lucky enough to be born in the post-independence era and need not face the ugly side of war and hard times.

In this momentary world, where there is so much hate and revulsion, people should start looking at the bright side of everything. “Merdeka” is a value of great significance that most people tend to overlook. Come to think of it, what would have happen if our country has not achieved independence yet? Will we still be suffering from the domination of foreign country? The road to nationhood is a long and bumpy one yet our ancestors fought for it through thick and thin. Now, as a proud Malaysian, it is our responsibility to preserve the spirit of “merdeka”. There are also two sides to every story and we should look at the positive side instead. At the end of the day, we were born in the same country, lived in the same nation, studied using the same textbook, ate the same grains, played on the same soil and speak the same language. Therefore, we are actually ONE in a way. Happy 52nd Independence Day. We stand by the slogan of 1 Malaysia.

*Above are the confessions by former ISA detainees who were tortured and oppressed during the detention period.

The Internal Security Act 1960 or commonly known as just ISA is a preventive detention law, first enacted to curb any communist’s activity that is deemed detrimental to the national security. Our very own native soil Father of Independence, Tunku Abdul Rahman Putra Al-Haj during his time affirmed that “My Cabinet colleagues and I gave a solemn promise to Parliament and the nation that the immense powers given to the government under the ISA would never be used to stifle legitimate opposition and silence lawful dissent“. Therefore, it is said that the core rationalization of enacting ISA is solely to restrain communist actions – nothing more, nothing less. This affirmation made my Tunku has proved otherwise when the Supreme Court (Theresa Lim Chin Chin & Ors. v. Inspector General of Police 1988 I MLJ 293) held that the scope of ISA is not only limited to communist insurgency and subversion. It has now broadened to the extent whereby ANY manner conducted by a person that the Minister believed is prejudicial to the security of Malaysia, he or she shall be detained under ISA for a period not exceeding two years (Section 8 of ISA). For example, telling the truth about the ugly side of our very own government might get you detained IF the Minister believed this will bring harm to the national security. Hence, sometimes truth-telling is not a good deed after all because some are not ready to handle the reality yet. Ignorance is bliss.

As of today, ISA is said to be draconian by many as it undermines the primary rights of human and nation democratic value. In most democratic system, every single citizen has the right to be informed of the grounds of his arrest without delay and shall be allowed to consult a legal representative of his or her choice. This fundamental human right of personal liberation is stated in Article 5 of Malaysia Constitution. Now, the most sardonic part is that Article 149 allows any laws made under them to be incoherent with other provisions of the Federal Constitution including provisions under fundamental liberties. One good example is the case of Jamaluddin bin Othman v Menteri Hal Ehwal Dalam Negeri, Malaysia & Anor (1989) 1 MLJ 367. Jamaluddin was detained under s.8(1) of the Act and the grounds provided by the Minister in the order referred to his activities to practice and propagate Christianity. While Islam is the official religion of the country, Article 11 provides that general public have the right to opt and practice their preferred religion. Although federal law may control or restrict the propagation of any religion among persons professing Muslim religion, is it necessary to detain Jamaluddin under ISA just because he wished to practice and propagate Christianity? Is it right to claim that his action is prejudicial to the national security by practicing Christianity? Apparently, there is abuse of power by the authorities and who really cares after all? In fact, Malaysians “mudah lupa”.

Additionally, Section 73(1) of ISA grants enormous power to police officers. Any police officer may without warrant arrest and detained pending enquiries any person whom he has reason to believe that there are grounds which would justify his detention. The decree, “he has reason to believe that there are grounds which would justify his detention” sounds almost too subjective to be true. Who will review the righteousness of the police officer’s and his decision when even the court is not in such position? On 12th September 2008, a Sin Chew reporter by the name of Tan Hoon Cheng was detained not more than 20 hours. The only ground provided by Home Minister Syed Hamid Albar as to why Tan was detained under ISA was to protect her from possible life threat after reporting controversial issue on Umno division leader’s racist remarks. This matter has certainly raised another controversy. ISA was not enacted to protect people from menace at the first place. Therefore, isn’t it ironic when the authorities misuse the power of ISA again and again?

Hence, by having ISA around, is there any separation of powers and limited government? It has already violated principles of the Rule of Law and Human Rights to begin with. If one is concerned that without ISA, there will be no special powers against subversion, organized violence and crimes prejudicial to national security, do not fret because we already have emergency ordinance since long ago to counter the above.

Coursemate’s Suffocation

I never come across to such a situation, where you, yourself and your race have been discriminated by the same race. Yeah right, you can say races issues always be with Malaysia, but not the issue where the same race discriminating among themselves. That was a real sad case, for sure.

This is from one of my fellow course mates, who I thought he could be the one who think so globally, act locally. Obviously, his action has had made me changed my view on him, I mean totally. He started off with an article showing our lecturer’s material, issue from an South East Asia country, which also suffering in races issues. He brought down his own background and experiences, claimed to disagree with the particular race to search for their origin roots. Well, in a certain extent, it is good to adopt the local culture when you came to a place which you do not belong to, but is that what your life meant to be? Stay and be fixed, be ignorant to whatever related to your roots. You do not feel like understand it?

Yes, my honored course mate, you born in English, grew up in English, play with English, eat with English and sleep with English. So you are used to it, you are now acting like a Englishman. Turn it over, still, you are a Chinese, no doubt and do not even doubt it. And you can’t change it, you know it. As a comparison, the Chinaman in your own context, has the same grown up condition you have. Chinaman, born in Chinese, grew up in Chinese, play with Chinese, eat with Chinese and sleep with Chinese. What do you think, then? Aren’t they hating the Englishman, too much, until to ignore all the English-speaking people? Everyone from Chinese vernacular school has to LIVE WITH IT, and we do not hate any of our same race. We studied China’s 5000 years history, not because we want to expand our power or wresting anything from anyone, we, at least, knowing where were we coming from, who were we, and what happened to make us a Chinaman. At least we learned how to be a real Chinese, not a hybrid one.

I found myself so emotional while seeing this coursemate has to suffer from others’ discriminations. As I met so many of them non-Chinese speaker but a Chinese, have learned the basic Chinese since university life started. Not because the Chinaman forces them to do so, it is because they are finally realized how important for themselves to do some self-learning on Chinese, at least one language from Mandarin, Cantonese, Hokkien and other native languages. I don’t really care actually, I can work with anyone, even if you claimed yourself as a ‘banana’, once I work with you I can die for you, even my English sucks. Because I’ve been taught to learn whatever that is necessary, even not in my culture background. I do not really care what language it is, you care because you felt so ashamed and furious on listening something that you totally do not understand, are you? Okay, I started to changed my tone like a public prosecutor. Apologize for that. Raise the best example, even our Sikh lecturer can speak basic Mandarin, what say you?

True it is really irony when Chinaman look down on Englishman’s Chinese, worse come to worst, Englishman who is a Chinese look down on Chinaman’s (who is a Chinese for sure) English! Nobody cares! We strive to the best, learn whatever we can; we did not ignore, and push whatever we don’t like to aside, only absorb what is our favourite/ we feel comfortable with, I assure this part is the most irony one!

“As much as the Chinaman beside me is allowed to be that rude, obnoxious, uncultured Chinaman, I should be allowed to be a modern, cultured, banana*.”

Quoted from this modern, cultured banana, I have to say, if Chinese are rude, obnoxious, uncultured, I urge you to read more newspaper, Chinese rather than English newspaper. Then spend more years to observe, you will finally found yourself not just banana, but blindly stubborn ignorance, and foolish banana, which is pale yellowish on the outside, white on the inside. Do not forget your ancestors who came from China, foolish!
